Sprintalk Terms and Conditions of Service
Acceptance of Terms and Conditions
1.1. These terms and conditions (“Terms”) establish the legal rights and obligations between Sprintalk and the client (“Client”) when engaging with the services and products offered by Sprintalk. By using any service or purchasing any product from Sprintalk, the Client agrees to be bound by these Terms and comply with all applicable laws and regulations. It is recommended that the Client carefully reads these Terms before using the services or acquiring the products.
Services and Products
2.1. Free Services:
2.1.1. Sprintalk offers free services that include the audio episodes of the podcast “Learn Spanish fast with Borja Sprintalk” and the audios of the 11 reverse translation lists.
2.1.2. Free services do not require prior registration and are available for personal, non-commercial use.
2.2. Free Services with Registration:
2.2.1. Sprintalk also offers free services that require registration, such as the transcriptions of the podcast episodes and the transcriptions of the 11 reverse translation lists.
2.2.2. To access the free services with registration, the Client must provide the requested information and create an account.
2.3. Paid Service – Spanish Sprint 1:
2.3.1. The “Spanish Sprint 1” is an online Spanish course offered by Sprintalk.
2.3.2. The “Spanish Sprint 1” course has three available payment options:
a) “Spanish Sprint 1 e-book edition”: This option includes all the written course content in ebook format, as well as the course audios. It contains all the lessons (21 in total) in PDF format, 21 reverse translation lists, and all the audios of the 21 lists. It also includes the “additional lists” pack, which consists of 25 additional lists and their 25 audio files. Access to the podcast and transcriptions is also provided. The price for this option is $69 USD, £69 GBP, or €69 EUR.
b) “Spanish Sprint 1 Complete Edition”: This option includes all the content from the complete course on an online learning platform. In addition to what is included in the “Spanish Sprint 1 e-book edition,” it provides all the content in video format (21 videos with a total duration of over 15 hours) and more than 10 interactive exercises. All the content is presented on an online learning platform with email support. Upon completion of the course, a certificate is awarded to the Client. The price for this option is $197 USD/GBP/EUR.
c) “Spanish Sprint 1 Complete Edition Plus”: This option includes all the content from the “Spanish Sprint 1 Complete Edition,” as well as a real conversation with Borja via video conference. The conversation should be requested within a maximum period of one year after completing the course. A video of the conversation will be recorded and provided to the Client for personal, non-commercial use. The Client may use the video of the conversation at their discretion, for example, to share it on social media, YouTube, or store it in the cloud, as long as it is not modified or edited in any way.
Use of Services
3.1. Registration and User Accounts:
3.1.1. The Client agrees to provide accurate, complete, and up-to-date information when registering to access services that require it.
3.1.2. The Client is solely responsible for maintaining the confidentiality of their account and password, and agrees not to share their username and password with third parties.
3.2. Intellectual Property:
3.2.1. All intellectual property rights regarding Sprintalk’s services and products, including, but not limited to, texts, images, videos, audios, and trademarks, are the exclusive property of Sprintalk.
3.2.2. The Client agrees not to reproduce, distribute, modify, or create derivative works from the materials provided by Sprintalk without prior written consent from Sprintalk.
Data Protection
4.1. Sprintalk is committed to using the personal data collected from the Client solely to provide a quality service and enhance the Client’s experience.
4.2. The collected data will not be shared with third parties without the express consent of the Client, unless strictly necessary to fulfill legal obligations or respond to legal requirements.
Payment and Cancellation
5.1. Payment:
5.1.1. The Client agrees to pay the corresponding price for the selected service or product when contracting Sprintalk’s paid services.
5.1.2. The prices indicated are valid in US dollars, British pounds, and euros, depending on the chosen option.
5.2. Cancellation and Refund:
5.2.1. The Client may cancel a paid service at any time, but no refunds will be provided.
5.2.2. In case of serious breach of these Terms by the Client, Sprintalk reserves the right to cancel services without prior notice and without refund.
Modifications to the Terms and Conditions
6.1. Sprintalk reserves the right to modify these Terms at any time.
6.2. Changes will be notified to Clients through appropriate means.
6.3. Continued use of the services or products after being notified of changes will constitute acceptance of the new Terms.
Limitation of Liability
7.1. Sprintalk shall not be liable for direct, indirect, incidental, or consequential damages arising from the misuse of services or products.
Applicable Law and Jurisdiction
8.1. These Terms shall be governed and interpreted in accordance with the laws of Spain.
8.2. Any dispute or conflict related to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Spain.
By contracting Sprintalk’s services or acquiring its products, the Client acknowledges having read, understood, and accepted these Terms and Conditions in their entirety. In case of any conflict or dispute, they shall be governed by the laws in force in Sprintalk’s country and shall be subject to the jurisdiction of its competent courts.
Duration and Termination
9.1. These Terms and Conditions shall come into effect from the moment the Client accepts them and shall remain in effect until terminated by either party.
9.2. The Client may terminate these Terms and Conditions at any time by canceling the services or ceasing to use Sprintalk’s products.
9.3. Sprintalk reserves the right to terminate these Terms and Conditions or suspend services in the event of a serious breach of obligations by the Client.
Indemnification
10.1. The Client agrees to indemnify and hold Sprintalk, its employees, directors, and affiliates harmless from any claim, demand, loss, liability, damages, or expenses (including legal fees) arising from the breach of these Terms and Conditions or the improper use of Sprintalk’s services or products.
General Provisions
11.1. If any provision of these Terms and Conditions is deemed invalid or unenforceable, such provision shall be interpreted to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.
11.2. These Terms and Conditions constitute the entire agreement between Sprintalk and the Client regarding the services and products offered and supersede any prior agreements or understandings, whether oral or written.
11.3. The waiver of any right or provision of these Terms and Conditions by Sprintalk shall not be considered a further or continuing waiver of such right or provision.
11.4. Sprintalk reserves the right to assign or transfer these Terms and Conditions, in whole or in part, to any third party without the Client’s consent.
11.5. Any notice or communication required or permitted under these Terms and Conditions shall be in writing and shall be deemed duly delivered when sent by email, postal mail, or posted on Sprintalk’s official website.
Términos y Condiciones de Servicio de Sprintalk
- Aceptación de los Términos y Condiciones
1.1. Estos términos y condiciones (“Términos”) establecen los derechos y obligaciones legales entre Borja Sprintalk (en adelante “Sprintalk) y el cliente ( en adelante “Cliente”) al contratar los servicios y productos ofrecidos por Sprintalk. Al utilizar cualquier servicio o adquirir cualquier producto de Sprintalk, el Cliente acepta regirse por estos Términos y cumplir con todas las leyes y regulaciones aplicables. Se recomienda al Cliente leer detenidamente estos Términos antes de utilizar los servicios o adquirir los productos.
- Servicios y Productos
2.1. Servicios Gratuitos:
2.1.1. Sprintalk ofrece servicios gratuitos que incluyen los audios de los episodios del podcast “Learn Spanish fast with Borja Sprintalk” y los audios de las 11 listas de traducción inversa “translation lists”. 2.1.2. Los servicios gratuitos no requieren registro previo y están disponibles para uso personal y no comercial.
2.2. Servicios Gratuitos con Registro:
2.2.1. Sprintalk también ofrece servicios gratuitos que requieren registro, como las transcripciones de los episodios del podcast y las transcripciones de las 11 listas de traducción inversa.
2.2.2. Para acceder a los servicios gratuitos con registro, el Cliente debe proporcionar la información solicitada y crear una cuenta.
2.3. Servicio de Pago – Spanish Sprint 1:
2.3.1. El servicio de pago “Spanish Sprint 1” es un curso en línea de español ofrecido por Sprintalk. 2.3.2. El curso “Spanish Sprint 1” tiene tres modalidades de pago disponibles:
a) “Spanish Sprint 1 e-book edition”: Esta modalidad incluye todo el contenido escrito del curso en formato ebook, así como los audios del curso. Contiene todas las lecciones (que son 21) en formato PDF, 21 listas de traducción inversa y todos los audios de las 21 listas. Además, se incluye el pack “additional lists”, que consta de 25 listas adicionales y sus 25 archivos de audio. También se proporciona acceso al podcast y a las transcripciones. El precio de esta modalidad es de 69 dólares americanos, 69 libras esterlinas o 69 euros.
b) “Spanish Sprint 1 Complete Edition”: Esta modalidad incluye todo el contenido del curso completo en una plataforma de formación en línea. Además de lo incluido en la modalidad “Spanish Sprint 1 e-book edition”, se proporciona todo el contenido en formato de video (21 videos con una duración total de más de 15 horas) y más de 10 ejercicios interactivos. Todo el contenido se presenta en una plataforma de formación en línea con soporte por correo electrónico. Al finalizar el curso, se otorga un certificado al Cliente. El precio de esta modalidad es de 197 dólares/libras/euros.
c) “Spanish Sprint 1 Complete Edition Plus”: Esta modalidad incluye todo el contenido de la modalidad “Spanish Sprint 1 Complete Edition”, así como una conversación real con Borja a través de videoconferencia. La conversación se deberá solicitar en un plazo máximo de hasta un año después de finalizar el curso. Se grabará un video de la conversación, y se proporcionará al Cliente para su uso personal y no comercial. El Cliente podrá utilizar el video de la conversación según su criterio, por ejemplo, para compartirlo en redes sociales, YouTube o almacenarlo en la nube, siempre y cuando no se modifique o edite de ninguna manera.
- Uso de los Servicios
3.1. Registro y Cuentas de Usuario:
3.1.1. El Cliente se compromete a proporcionar información precisa, completa y actualizada al registrarse para acceder a los servicios que lo requieran.
3.1.2. El Cliente es el único responsable de mantener la confidencialidad de su cuenta y contraseña, y se compromete a no compartir su usuario y contraseña con terceros.
3.2. Propiedad Intelectual:
3.2.1. Todos los derechos de propiedad intelectual sobre los servicios y productos de Sprintalk, incluyendo, entre otros, textos, imágenes, videos, audios y marcas comerciales, son propiedad exclusiva de Sprintalk.
3.2.2. El Cliente se compromete a no reproducir, distribuir, modificar o crear obras derivadas de los materiales proporcionados por Sprintalk sin el previo consentimiento por escrito de Sprintalk.
- Protección de Datos
4.1. Sprintalk se compromete a utilizar los datos personales recopilados del Cliente únicamente para proporcionar un servicio de calidad y mejorar la experiencia del Cliente.
4.2. Los datos recopilados no serán compartidos con terceros sin el consentimiento expreso del Cliente, a menos que sea estrictamente necesario para cumplir con obligaciones legales o responder a requerimientos legales.
- Pago y Cancelación
5.1. Pago:
5.1.1. El Cliente se compromete a pagar el precio correspondiente al servicio o producto seleccionado al contratar los servicios de pago de Sprintalk.
5.1.2. Los precios indicados son válidos en dólares americanos, libras esterlinas y euros, según la modalidad elegida.
5.2. Cancelación y Reembolso:
5.2.1. El Cliente puede cancelar un servicio de pago en cualquier momento, pero no se realizarán reembolsos.
5.2.2. En caso de incumplimiento grave de estos Términos por parte del Cliente, Sprintalk se reserva el derecho de cancelar los servicios sin previo aviso y sin reembolso.
- Modificaciones a los Términos y Condiciones
6.1. Sprintalk se reserva el derecho de modificar estos Términos en cualquier momento.
6.2. Los cambios se notificarán a los Clientes a través de los medios apropiados.
6.3. El uso continuado de los servicios o productos después de la notificación de cambios constituirá la aceptación de los nuevos Términos.
- Limitación de Responsabilidad
7.1. Sprintalk no será responsable de los daños directos, indirectos, incidentales o consecuentes derivados del mal uso de los servicios o productos.
- Ley Aplicable y Jurisdicción
8.1. Estos Términos se regirán e interpretarán de acuerdo con las leyes de España.
8.2. Cualquier disputa o conflicto relacionado con estos Términos estará sujeta a la jurisdicción exclusiva de los tribunales competentes de España.
Al contratar los servicios o adquirir los productos de Sprintalk, el Cliente reconoce haber leído, comprendido y aceptado estos Términos y Condiciones en su totalidad. En caso de cualquier conflicto o disputa, se regirán por las leyes vigentes del país de Sprintalk y se someterán a la jurisdicción de sus tribunales competentes.
- Duración y Terminación
9.1. Estos Términos y Condiciones entrarán en vigencia desde el momento en que el Cliente acepte los mismos y continuarán en efecto hasta que sean terminados por cualquiera de las partes.
9.2. El Cliente puede terminar estos Términos y Condiciones en cualquier momento cancelando los servicios o dejando de utilizar los productos de Sprintalk.
9.3. Sprintalk se reserva el derecho de terminar estos Términos y Condiciones o suspender los servicios en caso de incumplimiento grave de las obligaciones por parte del Cliente.
- Indemnización
10.1. El Cliente acepta indemnizar y eximir de responsabilidad a Sprintalk, sus empleados, directores y afiliados, de cualquier reclamo, demanda, pérdida, responsabilidad, daños o gastos (incluyendo honorarios legales) derivados del incumplimiento de estos Términos y Condiciones o del uso inapropiado de los servicios o productos de Sprintalk.
- Disposiciones Generales
11.1. Si alguna disposición de estos Términos y Condiciones se considera inválida o no aplicable, dicha disposición se interpretará en la medida máxima permitida por la ley aplicable, y las demás disposiciones permanecerán en pleno vigor y efecto.
11.2. Estos Términos y Condiciones constituyen el acuerdo completo entre Sprintalk y el Cliente en relación con los servicios y productos ofrecidos, y reemplazan cualquier acuerdo o entendimiento previo, ya sea oral o escrito.
11.3. La renuncia a cualquier derecho o disposición de estos Términos y Condiciones por parte de Sprintalk no se considerará una renuncia adicional o continua de dicho derecho o disposición.
11.4. Sprintalk se reserva el derecho de ceder o transferir estos Términos y Condiciones, en su totalidad o en parte, a cualquier tercero sin el consentimiento del Cliente.
11.5. Cualquier notificación o comunicación requerida o permitida en virtud de estos Términos y Condiciones se realizará por escrito y se considerará debidamente entregada cuando se envíe por correo electrónico, correo postal o se publique en el sitio web oficial de Sprintalk.
